While the investigation into the death of the 3 year old boy is still underway, detectives with the Montgomery County Sheriff’s Office Major Crimes Unit have arrested three (3) people, each charged with injury to a child.

The three (3) year old victim was pronounced dead last night after being taken by ambulance to a local hospital.  An autopsy confirmed investigators suspicions that the child died of blunt force trauma to the body. 

Criminal charges could be upgraded as the investigation proceeds.

Original Press Release

On 08-31-2009 at approximately 6:40 PM, Deputies with the Montgomery County Sheriff’s Office Patrol Dist-3 were called to a residence on Edgefield Lane in East Montgomery County in reference to a welfare check regarding a 3 (yoa) male not breathing. When deputies arrived they found that E.M.S. personnel were performing C.P.R. on the child.  The child was taken to St. Lukes Hospital in The Woodlands by ambulance where he was pronounced dead at approximately 7:30 PM.

 Detectives from the Major Crimes Unit responded to both the scene and the hospital. It appeared that the 3 yoa may have suffered some sort of recent trauma. The residence was secured and a search warrant was obtained to look for evidence into the cause of this child’s death. Crime Scene Investigators and Detectives are currently examining the home for evidence.

The body of the 3 yoa was taken to the Southeast Forensic Center in Conroe by order of Justice of the Peace Connelly and an autopsy is expected later today.  The name of the deceased is not being released at this time.

There were numerous adults and other children living at the residence. Child Protective Services removed (5) five children from the home. The children’s ages ranged from 2 to 12 years old.

Detectives worked throughout the night conducting interviews and examining evidence.  The investigation is continuing this morning.

    I hope these sickos get the same thing they did to this baby! I have been thinking for awhile what to write here so here it is! If you don’t like what I got to say then I am sorry in advance. Me and my wife have been trying to have a baby for 8 yrs now. Then you got idiots like this if this child was so much trouble we have a program in this state where they could have droped this child off at any hospital, fire house, or police station with no questions asked. This child did not deserve to die I mean come on what could a 3 yo do so bad that not only did they kill him they beat him. What was he being a baby and crying or what runing your party just sick. I just want any one who might be reading this and thinking of killing their child contact me before you do this cowardly and most stupid act.If you can not handel it please drop the child off at the above mentioned places and at least the child will have a chance at LIFE!

    Hey Newton,
    These insane sick animals don’t give these kids up because in order to give one up they’d have to give up the child support, welfare support or that added income in which they receive for having the child in the 1st place. I don’t think this was pre-meditated therefore wouldn’t have dropped the child off before they got to the boiling point and released their anger against the innocent child. I often ask myself why these people don’t have enough in them to just walk away long enough to cool down, but most people these days weren’t bred to ‘just walk away’. To walk away/turn the other cheek these days shows a sign of weakness, even when it’s walking away from a mere child that could do no harm. People are just programmed all wrong! IMO

    Update the D284th court has set bond on all these indavidules at $250,000 for injury to a child. The Herrera subject also has failuar to appear, violate promise to appear, no driver license, and speeding out of JP4. Which makes me believe this subject should not have a bond at all because he is a flight risk according to his record.
