Mr Heath is lucky they admited their mistake. My teenage son is also a victim of Officer Uber’s own interpretation of the law. Unfortunately as a minor you are guilty and good luck proving otherwise. It has been 3 months of total hell and there seems to be no end. The Juvenile Probation department makes their own rules and one is forced to abide. He is so lucky you have the media as an outlet to get attention. We are not so lucky. The treatment we have had is basically being told we are liars.

Someone forgot about “Brown vs. Texas”
    Look it up.

He should have paid for the Taco-

  4. Peter says:

Brown vs. Texas doesn’t apply in this case. Here the deputy did lawfully detain Mr. Heath based on the report of theft from a business establishment. Upon investigating he had every right to request Mr. Heath identify himself. Brown vs. Texas showed police had nothing other than the unsubstantiated belief that suspicious activity was taking place based on individual behavior and the area in which it took place at. I do believe, however, that pursuing such a charge against Mr. Heath was a waste of Government resources and effort. I’m glad the ticket was dismissed.

Jim- Perhaps you misinterpreted the story but Mr. Heath did not receive any tacos and therefore should pay for goods he did not receive. I’m not sure what your basing your comment on.
