MCSO Press Release – Cleveland Shooting – Penton

sopatch5On 1.31.2010 Montgomery County Sheriff’s Office Patrol units from district 3 were dispatched to 22300 block of Morgan Cemetery Rd in Cleveland, TX at approximately 0047 hrs.  While units were in en-route they were advised by dispatch that the Father was threatening to shoot the Mother in the residence.  The second 911 call was received a few minutes later and Deputies were advised that multiple shots had been fired in the bedroom.  Units arrived on scene and cleared the residence where they found Terrence Dwayne Penton Sr., w/m, 08.31.1961, in the master bedroom suffering from a gunshot wound to the head.  The shooter was identified as the victim’s wife, Kay Lynn Penton, w/f, 09.25.1958.Terrance Penton Sr was pronounced dead by EMS upon their arrival.

Detectives from the Major Crimes Unites and Crime Scene Investigators were then dispatched to the scene.  Interviews were conducted with two adult witnesses and the adult female shooter at the scene, where it was learned that the victim had arrived home intoxicated and was pointing a shotgun at his wife threatening to kill her and himself.  Evidence collected at the scene shows that the victim fired at his wife at least three times with a shotgun.  The shooter returned fire with a handgun causing a fatal wound.  There were also three young children, ages from 5 to 8 years of age, inside the house at the time of the shooting.

At the time of this press release no charges have been filed and no arrest is expected.  This case will be referred to the Montgomery County Grand Jury for review.

Detectives and Crime Scene are currently still at the residence processing the scene.  There is an extensive history of family violence at this residence involving Terrence Penton Sr.
