Montgomery County, Texas – Home of “Crony Capitalism” wherein the favored few and politically well-connected get all sorts of benefits paid for with public dollars.
Grab a cup of coffee, clear your schedule and prepare to read documents filed in a civil lawsuit titled CONROE CREOSOTING v. MONTGOMERY COUNTY, et. al. that exposed the ugly underbelly of the “good ole boy” system still alive and well in this county.
In anticipation of this years upcoming election it seems appropriate to shine the disinfectant “light of day” on this particularly egregious and long-hidden civil lawsuit that came to my attention last year so that voters are better informed when they go to the polls. I also implore people who don’t normally vote to make the effort this year as the necessity for “cleaning house” in this county is greater than ever before.
This is about a lawsuit that arose out of J. R. Moore, Jr.’s and Myrta Kaye Applewhite’s handling of a ($75,000) 1996 tax levy and subsequent March 13, 1997 seizure action that gives a whole new definition to the word “sordid”.
An action that is alleged to have intentionally “ruined” a 50+ year old Conroe business and the family that owned it.
The 1997 lawsuit (not concluded until 2003) named not only the county as one of the 13 defendants but several other individuals employed by the county including tax assessor J. R. Moore, Jr. and the collections law firm of Heard, Goggan, Blair & Williams now known as Linebarger, Goggan, Blair & Sampson along with attorney M. Kaye Applewhite now known as M. Kaye Brouse, who was also named in more than one sworn deposition in the case (by her own co-defendants) as the “ringleader” of the “legally questionable” seizure action underlying the suit. A seizure alleged to be the plausible “cover” needed and relied upon by Applewhite/Brouse to carry out what plaintiffs believed was Applewhite/Brouse’s personal “vendetta” against the businessman plaintiff.
A vendetta believed by the plaintiff to have stemmed from Applewhite/Brouse personally blaming him for her loss of the district judgeship she ran for in 1996. (Click Plaintiff Affidavit)
It should be noted that Applewhite/Brouse was an employee of the county in 1996 when she and her co-worker at the time, David Walker, both ran for public office while working as assistant county attorneys under then County Attorney, Frank Bass, Jr.
Applewhite/Brouse ran for (and seems to have greatly “coveted”) the District #410 judge seat while her colleague, Mr. Walker ran against Mike McDougal for District Attorney. They (Applewhite and Walker) both lost their bids. (Click 1996 Primary Election Doc)
In legal filings the plaintiff reported that sometime prior to the election, when approached and asked for his backing of her candidacy, he told Applewhite/Brouse and her husband, that he would not support her run for the office she was seeking. It is alleged that Applewhite/Brouse harbored a festering anger towards the politically active plaintiff after losing her bid for the judgeship.
Also, it was reported that very soon after losing her bid for the judge’s seat, Applewhite/Brouse accepted new employment at the collections law firm of Heard, Goggan, Blair & Williams where her new position just happened to strategically position her to be able to carry out the alleged “vendetta”.
Prior to Applewhite/Brouse moving over to Heard, Goggan, county tax assessor/collector J.R. Moore, Jr. was alleged to have had a “private” understanding with the businessman plaintiff that Moore would “work with” the businessman until his multi-million dollar company could see its’ way clear to catch up with its’ delinquent business personal property taxes.
It was Plaintiff’s belief that, as soon as Applewhite/Brouse went to work for Heard Goggan, Mr. Moore (figuratively) “stabbed plaintiff in the back” (regarding their prior “understanding”) in that he alleged that Moore did the “favor” of giving attorney Applewhite/Brouse the go ahead to “seize” all the assets of the two businesses owned by plaintiff (even though one of the businesses owed not one penny in back taxes)! The manner in which this particular action was carried out resulted in the complete devastation of plaintiff’s two businesses both of which were never able to open again after all the dust had settled.
As near as I can tell, instead of being FIRED by Heard, Goggan for her part in the reputedly illegal seizure action, Applewhite/Brouse appears to have subsequently been “rewarded” with a “partnership” at the law firm where she currently is still in charge of the firm’s Montgomery County collections office in Conroe and still working closely on a daily basis with her crony, Mr. Moore (the tax collector who seems to have so many “favors” up his sleeve).

I found your post informative and enlightening, I would like to ask some questions concerning how the election system works in Montgomery county, and how I can possilbly find out more on how a judge rules in certain cases, I have no idea how to do this, but there must be some way to get a judge’s rulings and how to look this particular public information up. Could you possibly tell me how I could go about doing this and checking public documents concerning a judge or judge(s) ruling on certain kinds of cases? And I would like to know, according to what I have found, when a judge turns in his contribution report how do I find out exactly who contributes to him, when I looked this info up all I saw were numbers, but no ledger information showing how a judge came about said contributions.

About your inquiry concerning searching judge’s “rulings”. The only place I know to steer you is to suggest starting at this link: http://www.findlaw.com/10fedgo…..ourts.html
If you scroll down to the state of Texas you will see all of the District courts links for each courts opinions, rulings etc. Hope this is helpful. Or if you would like to post here the specific ruling (and judge) you are interested in I will try and find out any info I can about it.
Also, if you google “campaign contributions” or the specific judge’s name along with the term “campaign contributions” you will get answers that you can click on and be brought to that database’s search page (where you will be able to put in the officeholder’s name).

I took your advice and didn’t find anything as far as case rulings, I am currently collecting information on how judge’s rule in domestic violence cases, and divorces where domestic violence is a factor. I would also like to know what happened in the case concerning Conroe creasole, what happened to all the deputies that found and misused this woman’s nude picture? Were there charges brought forth in their conduct? Was a civil case filed against them? I am new to this area and found your web site by accident…your articles are very enlightening, don’t you worry about what all these high ranking officials will do? It’s a tight circle like any corruption, like the mafia they cover for each other, and cover for each other…..on and on….
Any feedback you could give me would be helpful…

Why don’t you let me in on why you are interested in judges domestic violence case rulings and which particular judge you are wanting info on? Maybe the readers will be able to help you out with info you don’t have now.
About the Conroe Creosote crimes….The head Constable (Billy Colson) died of natural causes (probably from the stress of anticipating going before the jury) before the case was concluded. One of the deputies (Emmitt Houser, Jr.) lost his job in retalitation for his going to the DA and County Attorney and telling all that he knew about his co-workers misconduct and criminal activities.
I have information that Houser is presently a law enforcement officer elsewhere.
Then there is the Justice of the Peace (Judge Grady Spikes) who was called into Constable Colson’s office to look at the nude photo and who comes off as a bold-face liar (along with several others) in his “sworn” deposition
……and I’ve been told by “kbrouse” (in the comment below this one) that he died some years ago of a heart attack and that his son, Trey, is standing in his father’s stead as the current MoCo Pct. 2 Judge!
The underlying conduct by the main “players” in the Conroe Creosote case is NOT isolated to this case only.
No, the Creosote “players” (and others in concert with them) are well aware of the fact that there is other specific documented details of this same type of systemic conspiracy to ruin people perpetrated upon other (unsuspecting persons) and being covered up all too ”smoothly” by some of the same powerful individuals (employed by the county) as took part in the Creosote “dismantling”.
The “bad guys” in charge of things may lose lots of sleep worrying about how many copies of detailed documents are out there and whose hands they are presently in AND when the details of all of their criminal acts will be exposed, too.
I’m intrigued about your collecting info on the judges rulings. Tell me more.

Your posting raises one BIG GLARING question, though, as I first saw your name attached to the Spikes comment above……….I asked myself why would Myrta Kaye Applewhite/Brouse be choosing only now to comment here in this Conroe Creosote Forum about so minor an issue……when YOU have chosen NOT TO ADDRESS ANY OF THE “DAMNING” EVIDENCE AGAINST YOU in this lawsuit since it was posted here on February 26th!

I also believe the seizure action was intentionally pursued in order to “ruin” the Hawthornes (and their 50 yr. old business) not so much because the mister wouldn’t back your run for a judgeship but because YOU were green-eyed jealous of his “prettier” wife.

For you KB, I can only say that I should let you look at my stat counter on my site. You should see who looks at your firms stuff, besides the publicans.com.
IRS, Rangers, Feds, 5th circuit and hundreds of cities, counties, and other lawfirms who do what you do. Sadler and Kapadia are a big hit with the feds, follwed by Pate Transportation.
You have to ask yourself, are they building a case, and or are the lawfirms going to file suit under anti-trust or Rico?

After reading the article over on TexasWatchdog.org I was not surprised (except I would have thought that Texas would be higher up in the ranking) given the corrupt nature of our legislature.
Having personally uncovered so much corruption going on all around us in this county, and then learning from the watchdog article that Texas is ONLY the 13th most corrupt state tells me that the 12 states that are MORE corrupt then Texas must be literally “unbearable” to live in. I can’t imagine MORE corruption than this state is full of.
One small consolation though, was that I was encouraged by seeing on the Watchdog website that they ask for people to email them tips (and they give the email address right HERE) about local corruption around the state.
I implore everyone and anyone so inclined to email Texaswatchdog.org with a link to this website (especially pointing them to public documents posted by maxxbuster) in regards to Judge Sadler, J.R. Moore, Aslam Kapadia and others.
For all of you citizens out there who think there is nothing YOU can do about all the corrupt politicians…..you are wrong!
