Attorney General Abbott Charges Montgomery County Adult Day Care Facility with Abusing Residents
Court order obtained by state removes 19 from Westridge Pinnacle Care in Spring
CONROE – The Texas Attorney General’s Office today charged an adult day care and its management with abusing the facility’s residents and improperly operating without a required state license.
Court documents filed by the Office of the Attorney General reveal that investigators with the state Department of Aging and Disability Services (DADS) uncovered verbal and physical abuse at the unauthorized facility. Based upon that investigation, the attorney general obtained a temporary restraining order from the 9th District Court of Montgomery County, along with an order authorizing DADS officials to remove 19 residents and transport them to a licensed facility where they will be safe.

The state’s enforcement action charges Westridge Pinnacle Care at 611 Westridge Drive in Spring and two of its officials, Hector J. Ibarra and Kenneth J. Price, with multiple violations of Texas law. A temporary injunction hearing on the case is set for 9:30 a.m. on May 7.
On March 16, DADS denied the defendants’ license to operate their adult day care facility. Despite the license denial, the defendants continued to serve elderly and physically disabled residents. As a result, today’s enforcement action charges the defendants with operating an unauthorized facility in violation of Texas law.
In addition, the defendants are charged with subjecting those under their care to physical and verbal abuse. An investigation by DADS officials – which included interviews with residents and their family members – revealed that residents endured dangerous headlocks, other upper body assaults and profanity while under the defendants’ care.
