Pct. 4 Constable Press Release – Illegal Immigrant Convicted of Felony Possession with Intent to Deliver

An illegal immigrant arrested by the Pct. 4 Constable’s Office on March 3 in connection with methamphetamine that would have brought around $.5 million on the street was convicted of first-degree felony Possession of a Controlled Substance with Intent to Deliver on Thursday in the 221st District Court of Judge Lisa Michalk.

Jurors sentenced 22-year-old Alquer Duarte to 40 years in prison.

Duarte and his associate, 23-year-old Hanner Pineda, were arrested as the result of an investigation involving the Montgomery County Precinct 4 Constable’s office, members of the Houston Police Department Narcotics Division and the US Drug Enforcement Administration.

Officers arrested Pineda in early February, after their investigation led them to the parking lot of a business in the 22600 block of US Hwy 59 where they witnessed a transaction in which Pineda delivered 2.5 pounds of methamphetamine to another subject. Two more pounds of methamphetamine was recovered from Pineda’s residence. He is also in the United States illegally.

Pineda pleaded guilty and testified against Duarte. As of this writing, Pineda has not been sentenced. 

Pct. 4 Constable Kenneth “Rowdy” Hayden, who was directly involved in the investigation, was on hand for much of Duarte’s trial and praised the jury’s decision, as well as the efforts of Assistant District Attorney Sheri Culberson who prosecuted the case.

“Ms. Culberson did an excellent job and we’re grateful to her and to the jurors who did the right thing,” Constable Hayden said.

“I think the verdict and the sentence send a clear message,” Constable Hayden said, “The citizens of Montgomery County are tired of the drug dealers and the lives they help destroy, not to mention all the additional crime their presence brings.”

Constable Hayden said the conviction and sentence were another victory in the ongoing war between law enforcement and drug dealers in southeast Texas.

Since Duarte and Pineda are in the United States illegally, upon completion of their sentences, the United States Department of Immigration and Customs Enforcement will return them to Mexico.
