After reading the Conroe Courier article posted here over the weekend availing Montgomery County Judge Alan Sadler the public "forum"to put his own "spin" on several of the very real and disturbing "issues" first exposed to the public on this website I feel compelled to respond. 

I thought starting a new topic here would be beneficial to the voters of the county to read and participate in.  Maybe logical minds will prevail. 

I am not unaware that many many residents of MoCo feel a genuine affection towards the Judge.  He, his dad and family have a long history here of public service and giving back to the community.  No doubt about that.

However, when official records, officially filed and certified, accessed and dated over a period of time, are systematically brought together (by date) a factual "picture" is painted (for those who are willing to look and examine).

The picture painted "is what it is".

The documents speak for themselves. Oh yes, I realize that some of the facts on documents are left open to interpretation. That is what I have been giving the readers here (my interpretation based on my own extensive knowledge of these matters) along with the actual documents for the readers to see for themselves and to decide for themselves if they agree with my "spin" on these things or have a differing opinion of their own.

I believe this is what makes our country great.  Free speech, Free thinking, Free Ideas.  Exchanged wherever the "forum" might be. And free access to the courts to settle any disputes arising from the exercise thereof.

In the Courier article the Judge is quoted making some statements that I believe are untrue.  He claims to be his indicted partner's "silent partner".  Please!

I don't believe he is a silent partner with Kapadia.  I have found no records that would indicate to me that the judge is silent in any of the numerous companies he is and has been involved with. Let alone these. He holds sales tax permits in his name for Kapadia/Sadler convenience stores and I believe he holds alcoholic beverage licenses as welll.

I believe the Judge has a motive for wanting the voters to think he is all about doing the public's business and not so involved in day to day operations of all of these businesses I have been exposing here on this site.

Nonetheless, public docs list him as a Director of one of the Kapadia businesses (along with his partners in other ventures, David Angel, Mike McIver and Kapafia himself) and another Kapadia business shows Judge Sadler is one of only two Directors plus the Vice President.

Also, public records show that Judge Sadler has been doing business with Kapadia since 1996 when Sadler took a note for $1.14 million from Kapadia's GBAK Properties, Inc. for a gas station/convenience store on loop 336 east in conroe. Records show further that Sadler has started several businesses with Kapadia since 1996 even as current as 2009.

Also, the Judge, who is a Director of First Bank of Conroe, was not "silent" in Kapadia's obtaining an extension of a $80,000 bank loan to Tri-Star Fuels (another Kapadia business) on June 2, 2009 as he, Alan B. Sadler, signed the loan documents as a "personally" guarantor on the loan (the document has been posted here already) and he also put up as further collateral his Sadler Development Property on North Frazier and 22,500 of his own shares of Woodforest Financial stock.

This shows a very "active" participation on the part of the judge as public records in montgomery County show no other filings of Kapadia or any of his businesses ever obtaining loans here before. It is a sure bet that Kapadia only came to First Bank of Conroe because of his partner's "clout" as a Director.

One other statement Sadler was quoted as making in the Courier, that I would challenge, was that the Tax Liens, exposed for the first time on this site, were not paid because of Hurricane Ike and that Kapadia had paid those liens recently.

I checked my source for those tax lien releases and they do not come up. So they do not look to have been paid yet……I will keep the public posted though as perhaps there is a lag time before it will post.

But, more important is his claim that "Ike" caused the non-payment of these taxes. That does NOT look to be the truth.  Take a look for yourselves at the actual liens posted in my article here (search "sadler" on home page upper right) and you will see that the State lien is for Workman's Comp payments way before "Ike" and the Federal Lien is for 941 employment taxes that had due dates on two of the quarters also BEFORE Ike.  Ike did not appear to even be on the horizon when these taxes were allowed to go unpaid. Just like so many other taxes connected to the Judge. 

It is sad to me that a man with as much admiration would continue the farce in the face of this type of official evidence to the contrary. Please step up and answer about

USA Oilfield taxes,

Development II Tax Liens (due before Ike)

and the Workmans Comp Tax Lien delinquent the year prior to Ike.

Also, why did you start a new business with a man who was already under a federal indictment?

And why didn't you pay Sadler Development Corp. property taxes for four years? 

And, why didn't you steip down from MCAD board in 2004 when the 2003 taxes first went delinquent per the statute in the Tax Code? 

And why did your Frazier Street property qualify for Timber and Agricultural Tax Exemptions when the Timber portion is inside the city limits of Conroe which it is my understanding is a disqualification for the exemption.

Didn't Mark Castleschouldt realize this?

And for each of those types of exemptions to be granted by Chief Appraiser you had to furnish several kinds of proof that the land was being used to the same extent other Timber and Ag was used, so why not release the documents you furnished MCAD that qualified that land for those exemptions. Then you will never have to confront that issue again.

It is issues like these, that I have learned from the public records that weigh heavy on me and that look like they need further examination to my way of thinking.

Please Mr. Sadler, step aside for the sake of this county. If you can't answer these easy questions with truth what hope is there for this county?

Texas law requires a corporation to have a board of directors.  A friend sits on a board of directors for a corporation where he has had to give input on a decision once.  Don't misunderstand terms.

Does he cash in 23000 shares of WF to First bank to secure a loan? There is more, but you would have to take the time to read it. Try reading his financial statement first.

Not much financial info in the PFS. Looks to me like Sadler failed to include a lot that was required by law. Seems to want to stay "under the radar" with personal businesses. Makes one wonder why?

What is there to hide about a legitimate business man's dealings if they are all honest and above board. What does he do that wouldn't hold up to scrutiny.  I have many friends and relatives that have NO PROBLEM with anyone scrutinizing their business dealings.

Why won't any of the power people actually address any specific questions raised? I think honest people know why. There no doubt is good reason in wrongdoer's minds that prevents them from one item at a time explaining THEIR position or actions that are being (according to them) misunderstood, looked at wrong, reported incorrectly etc.

Why they haven't faced each issue raised here and put it to rest with facts that can be substantiated and that will hold up to whatever scrutiny so we can move on seems quite evident to me.  If Judge Sadler had such answers for issues I've raised here he surely would have no problem explaining and laying that issue to rest. I would be happy to never raise it again if it is found to have merit and to be true and honest.

I am only interested in the dealings of public officials because they are elected to positions of power and responsibility and we the public have to place our "trust" in their actions on our behalf.

Nowadays, we thankfully have the means to "check up" on politicians  true characters and find if they are truly the people we imagine them to be when we cast our votes that put them in office.  Thanks to the internet and the PIA we can learn whether they are one person in front of the cameras and news media and another behind the scenes. We all can learn from looking at the whole "body of evidence" available in the public records a lot more about whether our leaders are in fact conducting themselves as the upstanding citizen's we hope they are and who can be trusted to do what is in the best interest of the citizenry and not just what is in their own self-interest.

I fully expect people to be very angry at me. Some will be angry to have their "image" of their favorite politician changed forever and some will be angry at having their own "image" changed forever.  So be it. 

In the final analysis, I did not have anything to do with the creation of these public records.  I merely have gathered them, preserved them, secured them and now post them for you all to decide what they mean and what you will each individually do about them.  I include my comments along with the documents only because I think I have a point of view to contribute that many agree with and those that don't agree with my point of view on these issues are certainly free to say so or to ignore it all if they choose. Great country we have here, no?

I know I will cast my vote in the coming elections this year and next very differently than ever before. So very much is at stake.

BTW…

isn't there a statute that  says that a holder of a Beer and Wine License for a convenience store is to lose their license if convicted of driving under influence of a "combination" of alcohol AND phenobarbitol?

Can anyone say, Brett Ligon s/b notified along with the TABC?
